General Terms and Conditions of Sale
Article 1: Object of the contract
The rental for an all-terrain electric scooter ride with Vict-e (according to the selected and/or available model) with its individual protective equipment and accessories by TrottNormandie (SDP Prestige).
Hereinafter referred to as 'the lessor' and a natural or legal person, hereinafter referred to as 'the lessee'.
Article 2: Equipment of electric scooters
All Vict-e scooters are provided with the following accessories: helmet (with disposable head cover), gloves (mandatory hand sanitizing with hydroalcoholic gel), and battery.
Article 3: Effectiveness, provision, and retrieval
- The rental takes effect when the lessee takes possession of the equipment and accessories provided to him. The risks will be transferred upon delivery of the equipment and accessories to the lessee, who will assume custody under his full responsibility, committing to use them in all circumstances 'as a good family man'.
- This contract is only valid for the duration of the rental.
- The lessee acknowledges that he has received the accessories and the said vehicle in good working order. The tires, brakes, and suspensions are in good condition. The lessee is responsible for any damage other than normal wear and tear suffered by the vehicle due to the use of routes unsuitable for traffic, shocks caused by the lessee, or any other causes beyond the lessor's control.
Article 4: Payment and payment methods for the service
- The entire service is paid for by the lessee(s) before the start of the ride.
- The accepted payment methods are cash and credit card.
- Upon reservation, a deposit may be requested. In case of cancellation by the lessee, this deposit will not be refunded (Article 1590 of the Civil Code).
Article 5: Use
- The lessee certifies that he is in a state of health compatible with the practice of electric scooter riding and certifies that he is fit to drive the rented vehicle without medical contraindications.
- Pregnant women are not allowed to participate in the activity.
- Accessible to anyone between 40 and 120kg and over approximately 1m45 in height.
- Not allowed for people with balance or mobility problems.
- By agreement between the parties, the lessee is strictly prohibited from intervening on the equipment in case of breakdown without the lessor's consent.
- The lessee undertakes to use the rented Vict-e scooter with caution and without danger to himself and third parties.
- In case of theft of the equipment, the lessee must immediately notify the lessor, file a complaint with the competent authorities, and provide a copy of the complaint report.
- Scooter rental is possible from a minimum age of 14. Any minor must be accompanied by a responsible adult.
Article 6: Liability for breakage, theft, damage to third parties, insurance
- The lessee does not benefit from any coverage for damages suffered by the scooter and the supplied equipment and personally assumes liability for said damages, breakage, and theft. He is responsible for the damages he may have caused to the electric scooter and also, if applicable, for the duration of its immobilization and the resulting financial loss. By 'damages,' we mean the cost of necessary repairs, which will be estimated by an independent expert. In the event of a total loss or theft of an electric scooter, the total purchase price at the date of said loss will be due by the participant. However, the lessee cannot be held responsible for the damaging consequences of hidden defects in the rented equipment or its hidden wear unsuitable for the intended use.
- In case of breakage, the lessee undertakes to return the damaged equipment, which must be recognizable and complete. The damages suffered by the equipment will be invoiced to the lessee according to the current rate of spare parts.
- Theft and loss of equipment are not covered. In these cases, the equipment will be invoiced to the lessee based on its new value.
- The lessor declares to have professional liability insurance for an obligation of means under normal conditions of use of the vehicle. Any damages caused by the lessee resulting from non-compliance with the instructions for use and safety stipulated in Article 9 and announced during the briefing before departure by the lessor, will result in the cancellation of the lessor's guarantees.
- In case of theft by the lessee, diversion, or any damage resulting from non-compliance with the rules of use or the terms of this contract, the lessor is entitled to seek recourse for the entire loss.
- The lessee is personally responsible for any traffic violation and is always responsible for the bodily and material damages he causes.
- The lessee is responsible for his personal belongings in case of deterioration or loss (mobile phone, glasses, clothing...).
Article 7: Deposit
- When the lessor provides the equipment, the responsible lessee will be asked to pay a deposit as mentioned in this contract, as well as presenting the identity card of the guarantor.
- This deposit is not cashed during the rental period.
- Upon return of the equipment, the deposit is refunded to the lessee, after deduction of any damages in accordance with the rates corresponding to the damage to the equipment.
Article 8: Lessor's eviction
- The accessories delivered with the equipment must not be removed or modified by the lessee.
- The lessee undertakes in general not to grant to the Vict-e scooter and the rented accessories any right, real or otherwise, in favor of anyone.
- For any violations of these commitments, TrottNormandie (SDP Prestige) is authorized to formally demand the lessee and to require the immediate return of the vehicle.
- The lessor may at any time interrupt the ride for the lessee who does not respect the instructions for use as well as the non-compliance with safety rules, without reimbursement.
- The lessee must not be under the influence of narcotics or alcohol that may impair the operation of the rented vehicle, under penalty of being excluded from the ride.
Article 9: Safety and usage instructions
- Always wear the helmet (mandatory) and the protective equipment provided by TrottNormandie throughout the ride.
- Mandatory wearing of closed-toe shoes (such as sneakers).
- Respect traffic regulations.
- During the ride, it is forbidden to drink, eat, use a phone, a camera, or a video camera.
- Maintain a safety distance of 5 to 10 meters between each scooter.
- Do not overtake the escort unless requested.
- Maintain a speed of 6 km/h in the presence of pedestrians or animals; pedestrians have priority throughout the entire journey.
- Jumping or intentionally skidding with the scooter is prohibited.
- Riding with more than one person on the scooter is prohibited.
- Maintain constant control over your speed and trajectory.
- Follow only the path and route taken by the guide to preserve the environment.
- Always keep both hands on the handlebars.
Article 10: Right to Image.
Certainly! In accordance with the terms and conditions, the tenant agrees that photographs or videos may be taken during the use of the rented scooters, especially during guided outings. The tenant consents to the use of these images, in which they may appear recognizably, for promotional purposes by TrottNormandie or its partners, including but not limited to the website. www.trottnormandie.fr, social media, brochures, and any other communication channels.
The tenant waives any claims or actions related to the use, dissemination, or reproduction of their image and releases Trottnormandie (SDP Prestige) from any liability in this regard.
